StratadrakeI am writing this to explain an apparent confusion regarding your submission #745742 ("Red the Growlithe") which was recently removed as a photography violation. (Disclaimer: I was not the one who processed its removal, and there is no need to inform you who did.)

As you stated in the description, you took a photograph of your dog and then 'traced' over it. This qualifies as a 'photomanipulation', especially since parts of the original (unaltered) photograph are still visible underneath your edits. You already know that we have chosen to not allow photography submissions on FAC, but this rule also extends to the creation of photo-manips. Please use our sister site "Photo Lucidity" for submissions of photographs or manips.

Now, why did we remove your submission and not anyone else's? This is a common illusion and misconception about enforcement. The first reason is because almost nobody takes the time to actually report them to our attention (in part because we don't have a genuine "Report" function, reports must currently be filed via e-mail or PM to a staff member). We receive maybe five reports per month about such things as copyvio, tracing, or photography. And in most cases, what reports we do receive are clear enough that we can take immediate action. I could begin listing submission IDs that have been removed as such violations, but it would do you no good because only site staff can review submissions after removal, anyone else would simply receive an 'Access Denied' error.

Now, about the use of photography as background work in 'other' submissions. This is a gray, fuzzy area of our current submission policy and we will be rewriting it in more concrete terms, but basically:

1 - We do allow using a digital camera to photograph art/fanart creations which cannot be captured using a scanner. Things such as sculptures or large craft items, even a limited amount of costuming ("cosplay"). In these cases the photograph must clearly focus on the artistic creation itself and avoid including elements which distract from the art work and draw attention to the photo itself. So if you drew a fake tattoo on your arm using a Sharpie you could technically photograph and submit that, provided it's just a photograph of just the tattoo itself, and not (for example) a full-body photo of you which just happens to display what you drew on your arm. And regarding cosplay, a photo of you wearing the costume can be acceptable simply as a means to show the costume's design, but a photo of you browsing merchandise at KumoriCon, even though you are in costume, would not.

2 - We do allow a limited use of stock or user-created photography to be used as a background layer or element to what is otherwise an artist-made drawing or painting (usually a digital drawing or painting). However, we must ask that the photograph is non-distracting from the artist-made drawing, e.g. that it is a non-essential element of the piece's composition. For example, you may be able to use a photograph of mountains and clouds as a backdrop against a drawing of a character you made (because it's your character that is the focus of the work, and the scenery is just for decoration), but the same photograph would not make an acceptable backdrop if you were attempting to draw a landscape or simply sketching birds flying among the clouds.

3 - In other words, if a photograph contributes 'more' to the finished work than what you actually drew/painted yourself, then it may be considered simply as a 'manip' or 'touch-up' of the photo itself, rather than simply using the photo as a minor, background element. This also means that we cannot accept such things as artist ID badges, captioned LOLcats, De-motivational posters if they are created primarily from photography.

4 - (And of course, we cannot accept screenshots from television or film for any use whatsoever because of our existing rules about copyrighted work.)

Again, when we receive reports of photography or photo-manips we have to make a judgement call on the matter before taking action. Is it a photo by itself, or is it used in combined with a user-made drawing/painting? Is the photograph a major or minor element in the piece's overall composition and effect? What would the piece look like if it did not incorporate a photo in the first place?

I apologize if our enforcement of the "no photography" rule seems inconsistent, we have had to recently step up our enforcement of this rule (and others), and we haven't updated our submission policy to reflect this yet. We will.
